TERMS AND CONDITIONS OF SALE
Participants must register to bid in the auction. Any bid made without proper registration will be considered invalid.
Cesh Auction reserves the right to deny participation without providing any reasons.
Buyer's Commission (10%): When a buyer places a bid and wins, they pay an additional 10% of the bid amount as a commission.
Seller's Commission (20%): The seller pays a 20% commission on the final bid amount received from the buyer.
Each bid constitutes an offer to purchase, whether by clicking the bidding button or any other bidding method.
The highest bid accepted by the auctioneer will be the purchaser unless the auction is subject to a reserve price or confirmation.
Sales may occur under one of the following terms:
NO RESERVE: The item has no minimum price, meaning the highest bid will win, regardless of the amount.
RESERVE: A minimum price must be met for the bid to be accepted. If this price is not met, the item may be withdrawn from the auction, as stated in the item description.
SUBJECT TO CONFIRMATION (STC): The owner has two business days after the auction to accept or reject the bid. Bids cannot be withdrawn after the hammer falls until the confirmation period ends. If accepted, the sale is deemed a sale by auction. This will be indicated in the lot description.
All items are sold “voetstoots,” meaning without any guarantees or warranties from Cesh Auction or the seller. Buyers are assumed to have thoroughly examined and accepted the items' condition. Cesh Auction is not liable for minor errors in item descriptions. Items can be viewed on Thursdays from 08:00 to 14:00. Refer to the FAQ and Returns Policy for more information.
The auctioneer has the right to control, regulate, and record the auction. These recordings are the primary evidence of the auction proceedings. The bidder’s record and vendor roll are available for inspection during normal business hours, free of charge, after the auction concludes.
The auctioneer may accept or reject bids at their discretion without explanation, including rejecting a previously accepted offer. In disputes between bidders, the auctioneer may re-auction the lot, and their decision is final. The auctioneer may withdraw any item before or during the auction without penalty or prior notice. The auctioneer reserves the right to extend bidding time if last-minute bidding wars occur.
No “ringing” or collusion between buyers is permitted. If suspected, the auctioneer may suspend or terminate the auction or prohibit the involved bidders from further participation.
The auctioneer is entitled to correct any bona fide error in the conduct or conclusion of a sale. If the error cannot be corrected, the auction may be deemed null, with no claims against the auctioneer or seller.
A sale is complete when the auctioneer announces it by the fall of the hammer or another customary manner.
Cesh Auction reserves the right to activate bidding extensions ("sniper protection") to ensure fair bidding opportunities for all buyers.
Cesh Auction strives to maintain site accessibility 24/7. However, due to maintenance, updates, technical difficulties, server overloads, or signal issues, occasional downtime may occur. If this happens near the end of an auction, Cesh Auction will attempt to resolve the issue promptly. However, Cesh Auction cannot be held liable for any bids lost due to system downtime.
Risk for each item passes to the purchaser at the fall of the hammer for a successful bid, even if the item has not been delivered. The purchaser bears the risk for items remaining at Cesh Auction’s premises, including any shortages or damages.
Payment for Auction Purchases:
LIVE AUCTION: Full payment must be made to Cesh Auction during or immediately after the auction via cash, card, or instant EFT.
ONLINE AUCTION: Full payment must be made within 48 hours after the auction concludes via EFT, card, or cash.
The purchaser must remove their purchases within 14 days of the auction’s conclusion and only after full payment clearance as specified in the invoice. A storage fee of R30 per day will be charged for items not collected within 7 days. Items not collected within 30 days will be resold to cover storage costs.
The purchaser agrees to these terms and conditions as binding, regardless of whether they are present at the time of the auction announcements. Special terms and conditions for each auction and lot may be announced before or during the auction. By registering for this auction, you agree to these terms and conditions.
